MSCI Joins Coalition In Supporting Legislation To Address NLRB Overreach
Last month, the Metals Service Center Institute joined the Coalition for Democratic Workplace and more than 50 other organizations to send a letter to lawmakers on the House Education and the Workforce Committee in support of H.R. 2700, the Employee Rights Act (ERA), H.R. 5513, the Modern Worker Empowerment Act (H.R. 5513), and H.R. 2826, the Save Local Business Act.
Broadly, these pieces of legislation would protect workers, entrepreneurs, and small businesses from overreach by the National Labor Relations Board (NLRB). Specifically:
- The ERA would guarantee workers could use secret ballots to choose whether or not to unionize and workers can vote their conscience without being harassed, retaliated against, threatened, or pressured to vote a certain way.
- The Modern Worker Empowerment Act would protect independent contractors by requiring the use of the longstanding common law test to determine a worker’s appropriate classification as either an independent contractor or a traditional employee; and
- The Save Local Business Act would codify into law the traditional joint employer standard that requires employers have “actual, direct, and immediate” control over employees to be considered joint employers.
As the letter explained, the NLRB’s “blatant bias and mishandling of its duties recently resulted in the Office of Inspector General chastising the agency for gross mismanagement and lack of candor.” Read the letter here.
