U.S. Government Makes Ruling On Imports Of Disposable Aluminum Containers, Pans, Trays, And Lids From China

The U.S. International Trade Commission (ITC) has issued a determination that says U.S. industry is materially injured by reason of imports of disposable aluminum containers, pans, trays, and lids from China. The U.S. Department of Commerce (DOC) also has determined these products are sold in the United States at less than fair value and subsidized by the government of China.

Chair Amy Karpel and Commissioners David S. Johanson and Jason E. Kearns voted in favor of the determination.

The Aluminum Foil Container Manufacturers Association (AFCMA) and its member companies had filed a complaint in May 2024 requesting the investigation. According to Packaging Dive, AFCMA’s attorneys plan to file new complaint to prompt ITC to investigate Chinese companies circumventing U.S. duties by transshipping their aluminum foil containers through other countries in southeast Asia, including Thailand and Vietnam.

As a result of the ITC’s affirmative determinations so far, the DOC will issue countervailing duty orders and antidumping duty orders on imports of disposable aluminum containers, pans, trays, and lids from China. The ITC’s public report on this matter will be available by May 26, 2025 on the ITC’s website.
